General Terms of sale of Market Place NEOAFRICA
Article 1: object
The present MARKETPLACE NEOAFRICA General Terms and Conditions of Sale apply to any order for Products made by a Buyer from a Seller. The Terms and Conditions may be modified or adapted at any time at the initiative of the Company. The applicable GTC are those in force on the date of placing the order by the Buyer and must be accepted by the Seller on each sale of the Product on the MARKETPLACE NEOAFRICA.
These T & Cs may, where applicable, be supplemented by the Seller's conditions, in particular with regard to delivery times and costs, the conditions of return of a Product, any commercial warranties granted by the Seller, subject to compliance with these terms and conditions.
Article 2 - Marketed Products - Availability - Obligations
The Buyer may select one or more Products from the different categories offered on the Marketplace.
In accordance with the provisions of the Consumer Code, the Buyer may, prior to his order, take note on the Marketplace of the essential characteristics of the Product or Products he wishes to order by going to the product sheet of the selected article. The offers are filled by the Sellers, the latter being solely responsible for the information provided on the Product.
The prices displayed on the Marketplace are, by default, indicated in euros and all taxes included and are applicable in metropolitan France. VAT is applied at the rates in effect at the time of placing the order. Product and price offers are valid as long as they are visible on the Marketplace.
Prices shown are excluding delivery costs unless otherwise stated. The delivery costs will be indicated before the final validation by the Buyer and are freely fixed by the Seller.
The sales contracts for the Products offered by the Seller on the Site are concluded between the Seller and the Buyer. The Seller undertakes to offer only available Products on the Site and to immediately remove from the Site any offer relating to Products that are no longer available. The Seller is solely responsible in the event of unavailability of the Product of which he alone has the mastery. The Seller is informed by email, through its seller interface and in his account by MARKETPLACE NEOAFRICA when a product he has put online has been the subject of an order by a Buyer. The Seller must then confirm the order concerned within 2 working days of receipt of the information referred to in the preceding paragraph.
Also, the Seller undertakes to consult regularly, and at least once a working day, his emails received at the address provided to MARKETPLACE NEOAFRICA when opening his account and, subsequently, in case of any change affecting this information, in order to be able to confirm the Products ordered by the Buyers. The confirmation of the order by the Seller implies for the Seller, the firm commitment to ship the Product (s) within the time indicated on its sheet. In the absence of a response from the Seller within the period referred to in the preceding paragraph, the sales contract will be automatically canceled and the Seller's account will be "on vacation". In the event of absence or unavailability of more than 2 working days, the Seller must temporarily suspend the putting on line of his Products for sale with the help of the tool "Disable" put at his
provision on the Service. The Seller agrees to honor at least 90% of orders for Products offered for sale on the Site since the opening of his account. Failing this, MARKETPLACE NEOAFRICA reserves the right to temporarily or definitively interrupt access to the
Service to the relevant Seller by suspending or terminating these terms and conditions under Article 11.
Article 3 - Order
Any order placed through the Marketplace assumes the express and unconditional acceptance of these Terms and Conditions, without this acceptance being conditioned by a handwritten signature on the part of the Buyer. The order will be valid and taken into account only from the full payment of the price of the Product in principal and accessories.
All ordering requires the creation of a Customer account. Once the account is created, the Buyer will have access to his Client area.
Access to this Customer area is conditioned to the identification of the Buyer using the email address specified when creating the account and the secret password and personal chosen. The Company can not be held responsible for any action taken on the Customer space by a third party to which the Buyer has communicated its identifiers or who would have access to the account due to negligence of the Buyer.
The Buyer agrees that the information provided when ordering is complete, accurate and up-to-date. The order can be made for a delivery address separate from the billing address.
The order commits the Buyer as soon as he confirms his payment by clicking on "Validate".
Following receipt of the order, the Company will send the Buyer an order confirmation email including the summary of the order and its number, then validate the order definitively by sending an order validation email. These emails will be sent to the email address entered during the creation of the Customer account.
The Buyer may consult the information relating to his order in the "order tracking" section of the Customer area.
The Company informs the Seller that an order for one or more of its Products has been made by a Buyer. The Seller has forty-eight (48) business hours to invalidate or confirm the availability of the Products and to accept the order. The Company then communicates by e-mail, via the validation e-mail or the refusal of order, to the Purchaser the availability or unavailability of the Products ordered.
If the Seller confirms the availability of the Products, the contract of sale is definitively concluded between the Buyer and the Seller. Upon confirmation by the Seller, the Buyer is debited with the amount of Products available; it is in no way charged the amount of Products indicated as unavailable by the Seller.
In the absence of a response on the availability of the Products within forty-eight (48) working hours after notification to the Seller of the order by the Company, the order is automatically canceled and the account of the Buyer will never be debited the amount of Products of the order.
The Seller is solely responsible in case of unavailability of the Product.
If the Seller confirms the availability of the Product, he undertakes to ship it and deliver it within the time indicated in accordance with the terms and conditions chosen by the Buyer and to confirm the shipment of the Product within forty-eight (48) hours. working hours on its Seller interface.

In no case can he use as a name or as a pseudo link url or other pointing to another external site. Otherwise, the Company reserves the right to delete the account without notice.
The Seller undertakes not to register under a name of User infringing the rights of a third party. He may not use a name of User infringing copyright, trademarks or other names and nicknames of a third party or other User.
Each User agrees to update his account and all related information as soon as possible. Only the User will be responsible for the consequences of any false information or statement to the Company or another User.
In any case the company reserves the right to validate or refuse any registration request.

To put the product online, the product sheet is subject to validation and is worth selling the Product.
At the time of the sale of a Product the Seller undertakes that:
* Only Authorized Products are offered for sale. Thus, the Seller may only sell Products corresponding to the predefined items in a predefined list accessible at the time of creation of the Product sheet.
* Only one publication per product is created.
* Products offered and put online are immediately available and their inventory status is updated.
* He has full ownership of the Product and the ability to sell and publish on the site.
* The product sheet proposed on the Site is completed as precisely as possible;
* The Products comply with the product description.
* The photos of the Products comply with the said Products. The seller is prohibited from publishing photographs whose content is inappropriate (nudity, violence ...);

Article 4 - Claims
Any claim relating to the order must be sent to the Seller through the Customer area.
Article 5 - Right of withdrawal
In accordance with the provisions of the Consumer Code, the Purchaser has a period of fourteen (14) clear days from the receipt of his order to notify his intention to return any product does not suit him.

Article 6 - Return
Apart from the right of withdrawal, the product may be returned in case of non-compliance with the order or defect.
In these cases, a request must be sent to the Seller through the Customer area. The conditions of return of the product can be consulted on the shop page of the Seller concerned or by contacting the Seller.
Article 7 - Payment of the price
Prepayment is done online during the validation of the order.
Without confirmation of the order by the seller within two business days it will be canceled at the same time as the order. The collection will be effective 7 working days after placing the order
The payment of orders made via the MARKETPLACE NEOAFRICA is made to the Company which collects the funds on behalf of the Seller.
Payments are made by credit card and Paypal. Bank cards accepted on the Marketplace are Carte Bleue, Visa and
Master Card. These payment cards must be issued by a banking or financial institution located in the European Union.
The Seller authorizes the Company, at the time of the conclusion of the sale by the Buyer, as a result of the acceptance of the offer by the Buyer and the payment by the Buyer of the Price of the Transaction, to be retained on the Total price of the transaction, a commission on each product sold
(shipping costs included in the total price of the transaction).
The commission calculation applied is determined as follows:

MARKETPLACE NEOAFRICA will pay the Seller's bank account the Sale Price, less the Commission calculated as specified above on the amount inclusive of the Transaction, provided that the Deal Price has been paid in full by the Seller. Buyer:
* Upon confirmation of receipt of the Product by the Buyer on the Site, except in case of return of the Article by the Purchaser under the conditions and within the deadlines provided for in the General Conditions of Sale;
* Or, in case of absence of confirmation of receipt by the Buyer, 7 days after the receipt of the product by the Buyer.
In the situation where the Seller has shipped the Products from a country outside the European Union, customs duties may be applied. These rights are the responsibility of the Buyer who is responsible for verifying the origin of the Product before placing an order. In the event that a buyer located outside the European Union has ordered an item from a Seller located in the European Union, customs duties may also apply. These rights are then the responsibility of the Buyer.

Article 8 - Deliveries

The deadlines indicated correspond to the time of processing, preparation and shipping of orders, as well as the delivery time of the carrier used by the Seller. They run as soon as the availability of the ordered Product is confirmed.
The delivery time depends on the delivery method chosen when placing the order.
The customer is informed by mail as soon as the order is shipped
In case of exceeding the specified time, the Buyer will be informed by email and he will be offered a cancellation of his order.
The products are delivered to the delivery address indicated during the order. Deliveries are made only in the SEPA area and the United Kingdom
Article 9 - Guarantee
Seller's commercial warranty
The commercial guarantees that may apply to the Products sold by the Sellers via the Marketplace are specified in the product sheet supplied by the Seller.
It is expressly stated that the guarantees mentioned in the description of the product sheets of the Site only apply to products sold directly by the Company on the Site outside the Marketplace and in no case to Products sold by the Sellers via the Website. Marketplace.
For any question about warranties relating to the Products offered via the Marketplace, the Purchaser also has the possibility, before placing an order, to put a question to the Seller using the "Contact Seller" feature.
Regardless of the commercial warranty that may be granted by the Seller, the Consumer has the Seller's warranty
valid for two (2) years from the date of delivery of the goods, with the understanding that the consumer benefits from a presumption of non-compliance during the warranty period except for second-hand products where the time is limited at six months. The Customer, as a consumer, has the choice between repairing or replacing the goods, subject to the cost conditions provided for by Article L. 217-9 of the Consumer Code.
The Consumer also has the legal guarantee of hidden defects (articles 1641 and following of the Civil Code) allowing him to choose between the resolution of the sale and a reduction of the selling price.
10. Applicable law
These Conditions are subject to French law. Any dispute concerning them falls within the jurisdiction of the French courts.
11. Suspension - Termination
In the case of the Terms and Conditions concluded by a Private Seller, the termination of these presents by either Party may be made at any time without notice. In case of breach by the Professional Seller to any of its obligations, MARKETPLACE NEOAFRICA may after formal notice, sent by any means remained ineffective for a period of 15 days, terminate the
